This End User License Agreement ("EULA") is a legal agreement between you and TOWER RUSH DROP LTD for the Tower Rush Drop software product, including the application, its media, associated documentation and any updates (the "Software"). By installing, copying or otherwise using the Software, you agree to be bound by this EULA. If you do not agree, do not install or use the Software.
1. License grant
TOWER RUSH DROP LTD grants you a limited, non-exclusive, non-transferable, revocable license to:
- Install and use the Software on devices you own or control for personal, non-commercial purposes.
- Access any associated online features (such as leaderboards) in accordance with this agreement and our Terms of Service.
2. License restrictions
You may not:
- Copy, modify or create derivative works of the Software.
- Reverse-engineer, decompile or disassemble the Software.
- Remove, alter or obscure any proprietary notices on the Software.
- Use the Software for any commercial purpose without authorisation.
- Use automated systems — bots, scrapers, memory editors — to access or manipulate the Software.
- Interfere with or disrupt the Software or its servers.
- Use the Software in any unlawful manner.
3. Intellectual property
The Software is licensed, not sold. TOWER RUSH DROP LTD retains all right, title and interest in and to the Software, including all intellectual property rights. This EULA does not grant you any rights to trademarks or service marks of TOWER RUSH DROP LTD.
- We own: the software code, algorithms, designs, graphics, text and other content in the application.
- You own: your personal data and any user-generated content you create using the Software (such as your chosen nickname).
4. User data and privacy
Your use of the Software is also governed by our Privacy Policy. The Software does not require an account or a password and does not collect your real name or email address. Online features transmit your chosen nickname and scores as described in the Privacy Policy.
5. Free to play
Tower Rush Drop is offered free of charge. There are no subscriptions to maintain. If in-app purchases are introduced in the future, they will be clearly marked and governed by the App Store's standard billing terms.
6. Warranty disclaimer
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOWER RUSH DROP LTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not warrant that the Software will be uninterrupted, error-free or free of viruses or other harmful components.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TOWER RUSH DROP LTD BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, including damages for loss of profits, loss of data, business interruption or any other commercial loss.
8. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination you must cease all use of the Software and delete or destroy all copies.
9. Updates and modifications
TOWER RUSH DROP LTD may provide updates, patches or modifications to the Software. These updates may be downloaded and installed automatically by your device. We reserve the right to modify this EULA at any time; continued use of the Software after changes constitutes acceptance.
10. Governing law
This EULA is governed by and construed in accordance with the laws of the jurisdiction in which TOWER RUSH DROP LTD operates, without regard to its conflict-of-law provisions. Any disputes arising from this EULA shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association.
